NCLT

The Petitioner respectfully submits that the present Special Leave Petition is being filed under Article 136 of the Constitution of India against the final order/judgment passed by the National Company Law Tribunal (NCLT). The impugned order is contrary to law and facts on record. The NCLT has failed to appreciate the material evidence and documents placed before it. The findings recorded are perverse, arbitrary, and unsustainable in law. The impugned order suffers from grave errors apparent on the face of the record. The principles of natural justice have been violated. The settled position of law under the Companies Act, 2013, and allied statutes has been ignored. The judgment has resulted in serious prejudice to the Petitioner. The NCLT exceeded its jurisdiction while passing the impugned order. Relevant statutory provisions and judicial precedents were not properly considered. The reasoning adopted is arbitrary and unreasonable. The rights of the Petitioner, including property and corporate interests, have been severely affected. No efficacious alternative remedy is available to the Petitioner. Hence, the present Special Leave Petition deserves to be entertained by this Hon’ble Court in the interest of justice.
