The Petitioner is filing the present Public Interest Litigation in good faith and in the interest of the public at large concerning orders and proceedings before the National Company Law Appellate Tribunal (NCLAT). The petition raises issues affecting fundamental rights guaranteed under the Constitution of India. The cause espoused herein concerns a large section of stakeholders, including investors, creditors, and employees, who are unable to approach this Hon’ble Court individually. The impugned action and inaction are arbitrary, illegal, and violative of Articles 14 and 21 of the Constitution of India. The authorities and tribunals have failed to discharge their statutory and constitutional obligations under the Companies Act, 2013, and allied laws. The inaction has resulted in grave injustice and erosion of public confidence in the insolvency and corporate adjudication framework. The matter involves questions of significant public importance affecting corporate governance and economic stability. There is no personal or private interest of the Petitioner in the present petition. The Petitioner has not approached this Hon’ble Court for any oblique motive or personal gain.
