The Petitioner respectfully submits that the present Transfer Petition is being filed under Article 139A of the Constitution of India for transferring the proceedings pending before the Hon’ble High Court/Lower Court to another competent forum. The Petitioner apprehends bias and lack of fair trial in the impugned proceedings. The continuation of the matter in the present forum is likely to cause miscarriage of justice. The Hon’ble Court below has failed to consider relevant facts and circumstances. The findings recorded by the Lower Court/High Court are perverse and unsustainable in law. The impugned proceedings suffer from gross errors apparent on the face of the record. The principles of natural justice have not been duly followed. The settled position of law regarding fair trial and impartial adjudication has been ignored. The Petitioner’s rights under Articles 14 and 21 of the Constitution have been prejudiced. The forum concerned has exceeded its jurisdiction while passing the impugned orders. Relevant statutory provisions and judicial precedents were not properly appreciated. The reasoning adopted by the Lower Court/High Court is arbitrary and unreasonable. No efficacious alternative remedy is available to the Petitioner. Hence, the present Transfer Petition deserves to be entertained by this Hon’ble Court in the interest of justice.
