Delay in Possession

The Petitioner respectfully submits that the present petition is being filed in the interest of persons affected by inordinate delay in handing over lawful possession of properties. The issue involves violation of fundamental rights guaranteed under Articles 14 and 21 of the Constitution of India. The delay in possession is arbitrary, unjust, and contrary to contractual and statutory obligations. The concerned authorities and developers have failed to discharge their legal duties. Such delay has caused severe financial loss, mental harassment, and hardship to the affected persons. The inaction amounts to unfair trade practice and abuse of dominant position. The impugned conduct is illegal and violative of settled principles of law. Despite repeated representations, no effective action has been taken. The affected persons are left without any efficacious remedy. The delay has resulted in denial of the right to shelter and livelihood. The conduct of the respondents undermines public confidence in the legal system. The issue involves questions of significant public importance. The continuing delay causes recurring and irreparable harm. Hence, this Hon’ble Court may be pleased to intervene and grant appropriate relief in the interest of justice.
