The Petitioner respectfully submits that the present Special Leave Petition is being filed under Article 136 of the Constitution of India against the final judgment and order passed by the Debt Recovery Appellate Tribunal (DRAT). The impugned order is contrary to law and facts on record. The DRAT has failed to appreciate the material evidence placed before it. The findings recorded are perverse and unsustainable in law. The impugned order suffers from grave errors apparent on the face of the record. The principles of natural justice have been violated. The DRAT exceeded its jurisdiction while passing the impugned order. Relevant statutory provisions, including the Recovery of Debts Due to Banks and Financial Institutions Act, 1993 were not properly considered. The reasoning adopted is arbitrary and unreasonable. The rights of the Petitioner to recover lawful dues have been severely affected. No efficacious alternative remedy is available to the Petitioner. Hence the present Special Leave Petition deserves to be entertained by this Hon’ble Court in the interest of justice.
